  • Dismissal of multi-million dollar lawsuit
  • – River Park, Inc. v. City of Highland Park, 184 Ill. 2d 290, 703 N.E.2d 883 (1998). Conceived and implemented strategy that resulted in the dismissal of a multi-million dollar civil rights lawsuit against the City of Highland Park. Ultimately, the Illinois Supreme Court agreed with the analysis in a decision which became one of the leading cases regarding res judicata in Illinois.

  • Won a $10.5 million verdict
  • – Hapag-Lloyd (America), Inc. v. Denton Cartage Co., Circuit Court of Cook County, Illinois. Won a $10.5 million jury verdict and judgment for contractual indemnification in favor of an international shipping company against a trucking company in a claim that arose out of a catastrophic injury lawsuit.
  • Won a $716,000 judgment
  • – Astor Plaza Condominium Association, et al. v Travelers Casualty and Surety Company of America and Merrimack Fire Ins. Co., Circuit Court of Cook County, Illinois. Won a $716,000 judgment in a bench trial in favor of individual members of a condominium association against an insurance company, plus an award of attorney fees under section 155 of the Illinois Insurance Code, for the insurer’s breach of its duty to defend and for bad faith and vexatious conduct.
  • Obtained preliminary injunction, Trademark
  • – Joey Sutphen v. Thomas Ferguson, et al., Circuit Court of Cook County, Illinois. Obtained preliminary injunction for business owner in case involving trademark infringement.
  • Obtained $750,000 arbitration award
  • – Advanced Imaging Ctr. of N. Ill. Ltd. v. Cassidy, 335 Ill. App. 3d 746, 781 N.E.2d 664 (2d Dist. 2002), appeal allowed, 203 Ill. 2d 543, 788 N.E.2d 727 (2003). Successfully represented radiologist in case against former business partner. Among other things, won appellate court affirmance of trial court’s refusal to stay litigation under unique provision of the Illinois Business Corporations Act, and thereafter, obtained $750,000 arbitration award.
  • Won summary judgement in class action lawsuit
  • – Pezl v. Amore Mio, Inc., 259 F.R.D. 344 (N.D. Ill. 2009). Won summary judgment for defendant in class action lawsuit brought under Fair and Accurate Transactions Act (“FACTA”).

  • Member of appellate team in Illinois Supreme Court
  • – Hansen v. Baxter Healthcare Corp., 198 Ill. 2d 420, 764 N.E.2d 35 (2002). Served as member of appellate team representing Baxter Healthcare on appeal from verdict in products liability case involving intravenous catheter connection.

  • Brief and argument before the Illinois Supreme Court
  • – Guillen v. Potomac Ins. Co., 203 Ill. 2d 141; 785 N.E.2d 1 (2003). Briefed and argued case before Illinois Supreme Court regarding various insurance issues.

  • Member of appellate team in Illinois Supreme Court
  • – Belleville Toyota v. Toyota Motor Sales, et al., 199 Ill. 2d 325, 770 N.E.2d 177 (2002). Member of appellate team which successfully obtained new trial for defense regarding claims under Illinois Motor Vehicle Franchise Act and for breach of contract.
  • Won summary judgement, Insurance
  • – TIG Indem. Co. v. McFatridge, 2007 WL 1063018 (C.D. Ill. 2007). Won summary judgment for insurer, finding no duty to defend or indemnify former State’s Attorney who was sued for wrongful arrest, malicious prosecution, false imprisonment, and infliction of emotional distress.
  • Mediated settlement of coverage suit, Construction
  • – Amelia Island Co. v. Lumbermens Mutual Casualty Co. et. al, Case No. 3:08 cv 933-J-32TEM, United States District Court, M.D. Fla. Saved client hundreds of thousands of dollars through mediated settlement of coverage suit arising out of underlying construction defect claim that involved three, multiple-unit condominium buildings. Used discovery and comprehensive investigation of alleged construction defects spanning multiple policy periods and involving multiple insurers to develop defense which avoided substantial exposure.
  • Won summary judgement, Insurance
  • – TIG Insurance Co. v. Horace Mann Ins. Co., No. 1-04-3880 (1st Dist. 2005), reported in Chicago Daily Law Bulletin, Vol. 151, No. 212 (October 28, 2005). Won reversal of summary judgment against client and obtained summary judgment in client’s favor from appellate court, declaring that client’s policy was excess. Client ultimately recovered over $1 million from other insurer for entire amounts client paid to settle underlying lawsuit.

  • Member of trial team for school board, Civil Rights
  • – Fuller v. Decatur School Dist. No. 61, et al., U.S. District Court, Central District of Illinois.  Member of trial team which defended School Board against civil rights claims by six students expelled for gang fight at football game, which gained national attention.  Defense Verdict reported at 78 F.Supp.2d 812 (C.D. Ill. 2000), aff’d, 251 F.3d 662 (7th Cir. 2001).
